Terms and Conditions
Please read these Terms and Conditions carefully before using the Justin Blackman Photography website (the “Website”). By accessing or using the Website, you agree to these terms. If you do not agree, please do not use the Website.
Important: These terms provide general information and are not legal advice. Consider having local counsel review them before publication.
1. About the Website
The Website is operated by Justin Blackman Photography (“we,” “us,” or “our”). It displays our photography, information about our services, and ways to contact or book us. Our contact details appear at the end of these terms.
2. Eligibility and Acceptable Use
You may use the Website only for lawful, personal, and informational purposes. You must not:
· copy, scrape, download, reproduce, or commercially exploit Website content without written permission;
· interfere with the Website’s operation, security, or availability;
· introduce malicious code, attempt unauthorized access, or probe for vulnerabilities;
· misrepresent your identity or submit false or misleading information; or
· use the Website in a way that violates applicable law or another person’s rights.
3. Intellectual Property
Unless otherwise stated, all photographs, galleries, videos, text, graphics, logos, branding, and other Website content are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws.
Viewing content does not transfer ownership or grant a license to use it. You may not save, reproduce, edit, publish, distribute, sell, train artificial intelligence systems on, or otherwise use our photographs or content without our prior written permission. Any authorized use must comply with the scope and credit requirements we specify.
4. Reporting Intellectual Property Concerns
If you believe material on the Website infringes your copyright or another intellectual property right, please email jpr.blackman@gmail.com with your contact information, a description of the protected work, the location of the material at issue, and a statement explaining the basis of your claim. We may request additional information before reviewing or acting on a notice.
5. User Submissions and Communications
If you send us an inquiry, testimonial, review, image, or other material, you confirm that you have the right to provide it and that it does not violate any law or third-party right. You remain responsible for what you submit.
Submitting an inquiry does not create a photographer-client relationship or guarantee availability. Please do not send confidential or sensitive information through general Website forms.
6. Services, Pricing, and Bookings
Website descriptions, portfolios, packages, pricing, promotions, and availability are provided for general information and may change without notice. A booking is not confirmed until the requirements in a separate written photography agreement are satisfied, which may include signing the agreement and paying a retainer.
If these Website terms conflict with a signed photography agreement, the signed agreement controls for the booked services.
7. Third-Party Links and Services
The Website may link to third-party websites, social media platforms, galleries, payment processors, or other services. We do not control or endorse them and are not responsible for their content, availability, security, or privacy practices. Your use of third-party services is governed by their own terms.
8. Website Availability and Disclaimer
We may update, suspend, restrict, or discontinue any part of the Website at any time. Although we aim to keep information accurate and the Website available, the Website and its content are provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law.
We do not guarantee that the Website will always be uninterrupted, error-free, secure, or free from harmful components, or that all content will be complete, current, or suitable for a particular purpose.
9. Limitation of Liability
To the fullest extent permitted by law, we and our owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of profits, or business interruption arising from or related to your use of, or inability to use, the Website.
Where liability cannot be excluded, our liability will be limited to the maximum extent permitted by applicable law. Nothing in these terms excludes or limits any liability that cannot legally be excluded or limited.
10. Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses, liabilities, costs, and expenses arising from your unlawful use of the Website, your submissions, or your violation of these terms or another person’s rights.
11. Privacy
Our Privacy Policy describes how we collect, use, disclose, and safeguard personal information and is incorporated into these terms by reference. By using the Website, you acknowledge that information transmitted online may not be completely secure.
12. Cookies and Similar Technologies
The Website may use cookies, analytics tools, and similar technologies to operate, understand usage, and improve performance. Our Privacy Policy explains the types of information these technologies may collect, how we use that information, and the choices available to you. You may also be able to manage cookies through your browser settings, although disabling them may affect certain Website features.
13. Governing Law and Disputes
These terms are governed by the laws of the State of Montana, United States of America, without regard to conflict-of-law principles. Any dispute must be brought in a court of competent jurisdiction in Montana, except where applicable consumer law gives you the right to bring a claim elsewhere.
14. Changes to These Terms
We may revise these terms from time to time. The updated version will be posted on the Website with a new effective date. Your continued use of the Website after changes take effect means you accept the revised terms.
15. General Terms
If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These terms constitute the entire agreement between you and us regarding use of the Website, except for any separate agreement governing photography services.
16. Accessibility
We aim to make the Website reasonably accessible to visitors. If you have difficulty accessing any part of the Website or need information in an alternative format, please contact us at jpr.blackman@gmail.com. We will make reasonable efforts to provide assistance.
