Justin Blackman Photography
Justin Blackman Photography (“we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit our website, submit an inquiry, request or purchase photography services, access an online gallery, or otherwise interact with us.
Important: This policy provides general information and is not legal advice. Our actual practices, website tools, service providers, and legal obligations should be confirmed before publication, and local counsel should review the final policy.
1. Scope
This Privacy Policy applies to personal information handled through our website and photography business. It does not govern third-party websites, social media platforms, payment services, gallery hosts, or other services that publish their own privacy policies.
2. Information We Collect
Depending on how you interact with us, we may collect:
· Contact information: name, email address, telephone number, mailing address, and preferred contact method.
· Inquiry and booking information: event type, event date and location, desired services, package preferences, scheduling details, referral source, and messages exchanged with us.
· Client and transaction information: contracts, invoices, payment status, order details, delivery preferences, and records of services provided. Payment card details may be collected directly by a third-party payment processor rather than by us.
· Photography and creative content: photographs, video, audio, names, likenesses, event details, gallery selections, print orders, testimonials, reviews, and content you submit or authorize us to create or receive.
· Website and device information: Internet Protocol address, browser and device type, operating system, referring pages, pages viewed, approximate location derived from an Internet Protocol address, dates and times of access, and interactions with website features.
· Cookie and analytics information: identifiers and usage information collected through cookies, pixels, analytics tools, and similar technologies.
· Other information: any information you voluntarily provide to us.
3. How We Collect Information
We collect information directly from you when you contact us, submit a form, book services, sign an agreement, make a payment, access a gallery, place an order, subscribe to communications, or otherwise interact with us. We may also collect information automatically through website technologies and receive information from service providers, referral partners, event organizers, family members, or other people involved in a photography engagement.
4. How We Use Information
We may use personal information to:
· respond to inquiries and communicate about availability, services, pricing, and bookings;
· prepare proposals, agreements, schedules, invoices, galleries, albums, prints, and other deliverables;
· provide, personalize, maintain, and improve photography services and the website;
· process transactions, maintain business and tax records, and manage client accounts;
· authenticate gallery access, fulfill downloads or orders, and provide customer support;
· send service-related messages and, where permitted, marketing communications;
· protect our website, clients, business, equipment, rights, and property; detect fraud or misuse; and troubleshoot technical issues;
· comply with legal obligations, respond to lawful requests, enforce agreements, and establish or defend legal claims; and
· create aggregated or de-identified information that does not reasonably identify an individual.
5. Legal Bases for Processing
Where applicable law requires a legal basis, we process personal information as necessary to perform or enter into a contract, comply with legal obligations, pursue legitimate business interests, protect vital interests, or act with your consent. You may withdraw consent at any time where consent is the basis for processing, without affecting processing completed before withdrawal.
6. Cookies and Similar Technologies
We may use essential cookies to operate the website and optional analytics or functionality technologies to understand usage and improve performance. Third-party tools may place or read their own cookies. You can adjust browser settings to block or delete cookies, but some website features may not function properly. Where required, we will request consent before using nonessential cookies.
Website Cookie Notice
Justin Blackman Photography uses essential cookies to operate this website and may use optional analytics or functionality cookies to understand usage and improve your experience. Where required, we will ask for your consent before using nonessential cookies. You can accept or decline optional cookies through the available cookie controls and manage cookies in your browser settings. Disabling cookies may affect some website features. For more information, please review this Privacy Policy.
7. Marketing Communications
We may send promotional messages when permitted by law. You may unsubscribe using the link in a marketing email or by contacting us. We may still send nonpromotional messages about inquiries, bookings, transactions, galleries, security, or changes affecting our services.
8. How We Disclose Information
We may disclose personal information:
· to vendors and service providers that support hosting, email, scheduling, customer management, electronic signatures, galleries, file storage, image processing, printing, album production, payment processing, analytics, marketing, accounting, insurance, and professional advice;
· to assistants, second photographers, contractors, venues, planners, or other participants when reasonably necessary to provide requested services;
· to a person or organization involved in a merger, acquisition, financing, sale of assets, reorganization, or similar business transaction, subject to appropriate protections;
· to courts, regulators, law enforcement, government authorities, or other parties when required by law or reasonably necessary to protect rights, safety, property, or the integrity of our services; and
· with your direction, consent, or authorization.
We do not disclose personal information to third parties for their own purposes except as described in this policy or with appropriate notice and authorization. If our practices constitute a “sale,” “sharing,” or targeted advertising under applicable privacy law, we will provide any notices and choices that law requires.
9. Photographs, Galleries, and Portfolio Use
Photography inherently involves capturing identifiable people and event information. Client agreements, model releases, gallery settings, and applicable law govern how images may be created, delivered, displayed, licensed, or used in portfolios and marketing. We will not treat this Privacy Policy alone as a substitute for any consent, release, or contractual permission required for a particular use.
Online galleries may be public, unlisted, password-protected, or otherwise restricted. Clients are responsible for sharing gallery links, passwords, downloads, and access credentials only with intended recipients. No online system can guarantee that a recipient will not copy or redistribute an image.
10. Payment Processing
Payments may be handled by third-party processors. Those providers process payment information under their own privacy notices and security practices. We may receive limited transaction details, such as payment status, amount, date, and a transaction identifier, but we do not necessarily receive or store full payment card numbers.
11. Data Retention
We retain personal information only as long as reasonably necessary for the purposes described in this policy, including providing services, maintaining business and tax records, preserving contracts and transaction history, resolving disputes, enforcing agreements, and meeting legal or insurance requirements. Retention periods vary by information type, relationship, legal obligation, storage capacity, and operational need.
Photography files may require substantial storage and may be archived or deleted according to our client agreement, delivery practices, backup procedures, and business needs. Clients should maintain their own copies of delivered photographs and should not rely on us to store files indefinitely.
12. Information Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission, storage, or security is completely reliable, and we cannot guarantee absolute security. You are responsible for protecting passwords, gallery credentials, and devices used to access our services.
13. International Data Transfers
Our service providers may process or store information in the United States or other countries. Those locations may have privacy laws different from the laws where you live. Where required, we use appropriate safeguards for cross-border transfers.
14. Your Privacy Choices and Rights
Depending on where you live and subject to legal exceptions, you may have the right to request access to, correction of, deletion of, or a copy of personal information; object to or restrict certain processing; withdraw consent; opt out of certain marketing, targeted advertising, sale, or sharing; and appeal a denied request.
To submit a request, email jpr.blackman@gmail.com and describe the request. We may need to verify your identity and authority before responding. Authorized agents may be required to provide proof of authorization. We will respond within the period required by applicable law and will explain if an exception applies. We will not discriminate against you for exercising a privacy right.
15. Children’s Privacy
The website and our services are not directed to children under 13, and we do not knowingly collect personal information online directly from children under 13 without appropriate authorization. Photographs may include children when a parent, guardian, school, organization, event host, or other authorized client arranges or participates in photography services. If you believe a child provided personal information to us without appropriate authorization, contact us so we can review the matter.
16. Third-Party Services and Links
Our website and communications may link to social networks, gallery platforms, payment services, maps, scheduling tools, or other third-party services. We do not control their privacy or security practices. Review their policies before providing information or using their features.
17. Automated Signals
Some browsers and devices offer “Do Not Track,” Global Privacy Control, or similar signals. Because legal and technical standards vary, our response may depend on the signal, browser, location, and technologies used. Where applicable law requires us to recognize a valid opt-out preference signal, we will do so.
18. Montana and Other U.S. Privacy Rights
Residents of Montana and other U.S. states may have additional rights under applicable state privacy laws. Whether a law applies can depend on factors such as the type and volume of data processed and the nature of the business. If a qualifying law applies to us, we will honor the rights and provide the notices required by that law.
19. Changes to This Policy
We may update this Privacy Policy to reflect changes in our practices, technology, services, or legal obligations. We will post the revised policy with a new effective date. When required, we will provide additional notice or obtain consent.
